Why Jammu Kashmir is not a state after 2019?

Before 2019, Jammu and Kashmir was a full state of India with a special constitutional status. This special position came from the Constitution of India, mainly through Article 370 and Article 35A. On 5 August 2019, the Government of India took a historic step that removed this special status and changed the state into two Union Territories. Because of this, Jammu and Kashmir is no longer a state today.
1. Removal of Article 370 and Article 35A
Article 370 gave Jammu and Kashmir a special autonomous status. It allowed the state to have its own constitution, flag, and decision-making powers. Many central laws did not apply there automatically.
Article 35A allowed the state legislature to define “permanent residents” and give them special rights related to jobs, land, and education.
On 5 August 2019, the Indian Parliament passed a resolution, and the President of India issued an order that effectively removed Articles 370 and 35A. After this, all provisions of the Indian Constitution became fully applicable to Jammu and Kashmir.
2. Jammu and Kashmir Reorganisation Act, 2019
On the same day, Parliament passed the Jammu and Kashmir Reorganisation Act, 2019. This law officially ended the state status of Jammu and Kashmir and reorganized it into two Union Territories:
Union Territories of Jammu and Kashmir – with a legislative assembly.
Ladakh – without a legislative assembly.
This law came into effect on 31 October 2019. From that date, Jammu and Kashmir stopped being a state and became a Union Territory.
3. What is a Union Territory?
A Union Territory is directly governed by the Central Government of India. Even if it has a legislative assembly, like Jammu and Kashmir (UT), the powers of the elected government are less than those of a full state. The Lieutenant Governor, appointed by the President, plays a major role in administration.
4. Government’s Reasons
The Government of India said that removing the special status and changing the region into Union Territories would:
Promote development and investment,
Improve law and order and national security,
Reduce corruption and separatism, and
Strengthen national unity under the idea of “One Nation, One Constitution.”
5. Supreme Court Decision
Many people challenged this decision in court. In 2023, the Supreme Court of India upheld the government’s action and said that Parliament had the constitutional power to make these changes.
Conclusion
Jammu and Kashmir is not a state after 2019 because Articles 370 and 35A were removed and the Jammu and Kashmir Reorganisation Act, 2019 reorganized the region into two Union Territories. This legal and constitutional change completely altered its status within the Indian Union.
